What should a foreigner do if their name is spelled differently in Ukrainian documents?

Error in a residence permit
a ground for exchanging the card
Short answer

Pick one Cyrillic spelling of your name, based on the notarised passport translation and your earlier Ukrainian documents, and use it in every procedure, because the State Migration Service (DMS) treats any difference as a data mismatch. A mismatch can get your case suspended or refused. A residence permit already issued with an error is exchanged.

Why a mismatch in your name is dangerous

Ukrainian authorities check a foreigner's data against state registers. When a new document spells your name differently from earlier ones, the register sees a different person. For the ДМС (State Migration Service, DMS) this is a direct reason to refuse. Among the grounds for refusing a посвідка (temporary residence permit, TRP), Cabinet of Ministers Procedure No. 322 lists the situation where register data do not confirm the information submitted.

The центр зайнятості (employment centre) takes a similar view. A wrong name or passport number counts as inaccurate data there, and the review of an application for a дозвіл на застосування праці (work permit) is suspended.

A mismatch is not always visible to the eye. І and Ї, Е and Є, a doubled consonant or a different patronymic ending all mean separate records to a register. That is why a mismatch has to be fixed before you file, not after a refusal. Other documents a foreigner usually arranges in the first months are covered in the guide to first steps in Ukraine.

Where different spellings come from

Transliteration is the most common cause. A Latin letter can be rendered in Cyrillic in several ways, and translators pick different options. There is no ready-made set of rules that can be applied mechanically to every name. The spelling is decided individually, and the one firm requirement is that it matches the Ukrainian documents you already hold.

Text recognition software is the second cause. It confuses similar letters and digits and sometimes adds a stray character to a passport number.

Time is the third. Over the years a person collects documents from different places, and every translator does things their own way. Without a check against earlier documents, a mismatch is almost inevitable.

What counts as the reference spelling

Each field has its own reliable source. The passport number comes from the machine-readable zone, the lines of characters at the bottom of the photo page, and not from the visual field above it. In passports of Uzbekistan and Tajikistan the number has a fixed length, and a simple length check catches most errors.

Your name in Ukrainian comes from the notarised translation of your passport. Once you already hold Ukrainian documents, above all an issued TRP, they take priority. A new translation should reproduce the spelling in your TRP even if another version looks more correct to you. How to order a translation properly is explained in the article on notarised translation.

How to fix a mismatch that has already happened

If the mismatch is only in a package you have not filed yet, you fix the package itself. The translation is redone with the correct spelling, and the application, the contract and the other documents are brought into line with it. Avoid handwritten corrections on a certified document.

When the error has already made it into an issued TRP, the card is exchanged. Paragraph 18 of Procedure No. 322 provides for an exchange when discrepancies in the records are found, and the documents are filed within one month. The exchange itself is described in the article on exchanging a residence permit.

An error in a work permit is corrected by the employer through an application for amendments, and this costs nothing. Details are in the article on amending a work permit.

A new passport with a different spelling

Sometimes a country changes how it transliterates names, and your new passport spells yours differently. A new passport of this kind triggers an exchange of the TRP and amendments to the work permit. The new spelling then has to be fixed as the reference for every later document. Never mix the old and the new spelling in one package.

How to prevent a mismatch

Prevention is easiest at the very start. Before your first Ukrainian document, decide how your name is written in Cyrillic and stick to it in every procedure. Keep a short sheet with the correct spelling of your first name, surname and patronymic, your passport number and your date of birth. You can hand it to the translator, to your employer's accountant and to the staff at the ЦНАП (administrative service centre, TsNAP).

If you hold more than one passport, for example because of dual citizenship, remember that the DMS requires all your passport documents to be submitted. The data in them may differ, and it is better to explain this in advance than at an interview.

Lawyer's experience

One telling trap involves the passport number. Text recognition software sometimes adds a single digit, and the error then travels into every document of the package. The documents match one another perfectly, so checking one document against another shows nothing. The error only becomes visible when the number is compared with the machine-readable zone of the passport.

That is why we check every field against the primary source rather than against other documents in the package. Before any translation we also ask the client to show us all the Ukrainian documents they already have. It takes a few minutes and saves weeks.

If your documents already contain mismatches, we provide notarised translation of documents with a full cross-check, and for a TRP that needs exchanging we prepare the exchange package.

Frequently asked questions

Why is the same name spelled in different ways?+

Latin letters can be rendered in Cyrillic in several ways, and different translators and software choose different options. That is why the spelling is decided individually, and it has to match the Ukrainian documents you already hold.

Which spelling is the correct one?+

The one already recorded in your Ukrainian documents, above all in the residence permit you were issued. For new documents the notarised translation of your passport is the reference, and you keep to it in every later procedure.

What if the error is already in my residence permit?+

An error or discrepancy found in the records is a ground for exchanging the residence permit. You file the exchange documents with the State Migration Service, and the corrected spelling then carries over into every new document.

Can a wrong passport number hold up my work permit?+

Yes. The employment centre does not treat a wrong passport number as a clerical slip, and the review of the application is suspended. Check the number against the machine-readable zone of the passport, not against your other documents.
